Abstract

Cutting off the salary is a discipline procedure imposed by management authority against its employees who commit breaches of law considered as breaking the occupational requirements, but these procedures should not be against the legislations, public principles of the law that ensure employees' rights and their main guaranties in order not to these employees will lose confidence and insurance at their job, consequently that would reflect negatively upon the occupational performance. Since policemen are considered a part of these employees so they are underwent to the same discipline procedures but in a special law called the criminal law for interior forces security, include security forces penalizations law (14) of the year ( 2008), and the law of origins of penal trails for interior security forces (17) for the year (2008), according to this, these educating procedures are called discipline punishments , cutting off the salary is one of them, this one is imposed on the policeman when he commit a breach of the law include an exceeding to the requirements of his job, considering these breaches are correlated with the society, he has to apply them properly , truly and neutrally via intact application for laws and implementing them, with concern with the rights, major guaranties for him like her right of condemnation the issued rules from the discipline officer within (7) days from notification date up to the item (24 ,1st ) of the penal trials law for interior security (No. 17 , year 2008), to authenticate the verdict or re-judge the defendant or commute the penalization or abolish it. Based on what we have mentioned above and to show how legal this penalization is when its imposed, we have searched that according to a plan included a preliminary request in the origin of the cut off penalization of salary for the policeman and its importance plus two sections, first one is specialized to study the procedures of cutting the salary of policeman and second is specialized for holding the implementing of the verdict and the effect of the forgiveness and then an epilogue included the most important results , suggestions we had come up with, list of resources and an abstract in Arabic and in English.
