(Criticism of the fraudulent hadith and its provisions in Islamic legislation)


The human need for laws regulating his individual and social life; It called him to devise a system for people's policy and to lead them - positively and negatively - towards compulsive or voluntary discipline; However, these human laws and what is similar to the many deviations from human nature - and the prevalence of injustice and aggression in most of the joints of their status - called on rational people to turn to the Divine Savior to save them from the oppression of darkness and the oppression of the sultans; So God Almighty sent messengers and prophets carrying His laws to them to organize their worldly lives with a heavenly system that guarantees them happiness in it as well as eternal bliss in the Hereafter. Then the Islamic Sharia came to be the conclusion of the divine laws that preceded it, and in the hand of the Seal of the Prophets and Messengers - the Truthful and Trustworthy - Muhammad bin Abdullah (peace be upon him) to guide people to the straight path, guiding them with the Great Qur’an, which became the first source and the miracle of the divine constitution for the worlds and the carrier of the eternal legislation that no Only God Almighty and the Messenger (peace be upon him) and those who are firmly rooted in knowledge from the family of Muhammad (peace be upon him) know the secrets of its verses and secrets of his unseen, and let the honorable Sunnah come explaining, clarifying and detailing everything that was mentioned in the letters, words, words and texts of the verses of the Noble Qur’an, and this year is considered the second source of Islamic legislation after The Qur’an complements one another and complements the Islamic religion with them. It is worth noting that the Holy Qur’an, God Almighty, pledged to preserve it by saying: . Except that the hypocrites indicated their impure (impure) action in order to carry the bad Sunnah and insert it among the narrative traditions as being from the Sunnah?! The imams of Ahl al-Bayt - peace be upon them - were nothing but an explanation of these heresies and misguidances for people in defense of the honorable Sunnah; So they enlisted their companions and elite students and ordered them to sift through the narrator’s heritage from everything that was fabricated and fabricated falsely and slanderously and attributed to the honorable Sunnah and had nothing from it. Through the research, we learned that fraud is the narration of hadith with words that are likely to be heard or not, such as (he narrated, said, about) and these words if the narrator spoke them about the speaker - if the speaker heard or did not hear him - an illusion of hearing and taking from him, and this by investigation and research was not achieved at all; Therefore, some hadith scholars and jurists decided not to accept his hadith at all, whether he knew that it was fraudulent or not, and that is because he deviated from justice by fraud. Therefore, we find a fraud ruling in their view that it is not permissible to take it; There is evidence that he is not considered, as well as there are oppositions to his experience. So the deception of the four types of isnaad deceit, and the consideration of “falseness is the brother of falsehood” and their denunciation of it vehemently against the deceivers, and it is included in his saying (peace be upon him): “He who deceives us is not one of us”; Because it deludes the listeners that his speech is connected and there is a break in this if he is deceived from trust. But if he misrepresents an experience on the authority of a weak person who pretends that it is true, then he has betrayed God and His Messenger. While others are of the opinion that it should not be responded to just because of that, rather what is known about the fraud is rejected, and what is not known is not. Because it is assumed that he was trustworthy without him, and fraud is not a lie, but rather a disguise that does not harm justice. It is disliked by most of the people of knowledge, and some of them see it as permissible and there is nothing in it. By researching and examining the opinions of some scholars regarding “falsification of chains of transmission,” it becomes clear to us that his ruling is severely disliked by them. Most of the scholars censured him and said things about him – indicating the hatred of his narration and its adoption in the field of legislation. The majority of scholars are of the view that deception by the elders is hated and the reason for its dislike is that it involves disturbing the way for the listener to know the elders, and in this it is lost to the narrator, just as it is also to the loss of the narrator; Because when he mentions his sheikh - something he is not known for - it may be a cause of his ignorance, so the listener may search for him and not know him, so he becomes unknown. Most of the hadith scholars are of the view that the deception of the sheikhs is less disliked than the deception of the chain of transmission. Because the deceiver did not cause anyone to fall, but the hatred is due to the loss of what is narrated about him and the distortion of the way of knowing him to the listener, and the situation differs in his dislike
