Permissibility of abortion fetus at the Imami jurists

Abstract

Abstract:According to the remarkable technological development that the world is witnessing. A person can follow the growth of a child from day to day while he is in his mother's womb.This matter is tantamount to innovation and innovation in the legal issues that concern this subject.The Islamic religion prohibits aborting a fetus in its mother’s womb, considering it a protected and forbidden soul. However, there are cases where the mother is forced to abort the fetus regardless of her consent or not. Imami jurisprudence permits some abortions that allow the mother to abort her child. Most of the jurists have gone to the permissibility of abortion in the event that the mother’s life is at risk, which could lose her life if the fetus remains in her womb. Some jurists have found that severe deformation of the fetus in the mother’s womb without affecting her is considered permissible for abortion. Some have argued that abortion is possible, if there is a danger to the mother’s life, provided that it is before the soul’s penetration and not after it! From this aspect, we came to this research to clarify through it the definition of abortion, from the linguistic, medical and jurisprudential aspect. Clarifying the history of abortion and the reasons for which the spouses are forced to resort to this process, and we have studied all of this according to the jurisprudential fatwas of our distinguished scholars in explaining the legal inferences for abortion from the Holy Qur’an and the narrations of the Ahlalbayt (peace be upon them). Then we shed light on the clarification of the legal issues and rulings on abortion according to the Imami jurists, as this process played an important role in society until it raised doctrinal questions, which prompted the jurists to vote on this issue.Key words: Permissibility, non-permissibility, abortion, fetus, jurisprudence, Imami jurists.
