Abstract

In this research، the researcher shows the types of error that occur in the judge’s judgment and the reasons that led to the judge’s occurrence of this error. Sometimes the error is intentional by the judge himself، for several reasons such as favoritism and taking bribes، as well as injustice and other reasons that call the judge to judge with a judgment that deliberately violates the right And about knowing، And sometimes the error in the judge’s judgment is unintentionally and deliberately، and this error occurs for reasons including suspicion and lack of sufficient knowledge، as well as perjury and other reasons، so the Islamic Sharia، as well as the law، has dealt with this matter and put several provisions for it، including reversal of the judgment before implementation if it is not implemented. As well as after implementation while the eye remains fixed، Among the provisions that the judge is subjected to when the error occurs in the judgment and intentionally is removal from office، as well as the guarantee، which is one of the provisions that fall on the judge as well، and sometimes it is on the state، and sometimes this guarantee is on the one who caused the loss of the right، as if the witnesses were when they gave testimony False or on the complainant or the one who caused the mistake
