Abstract

The principle of legitimate expectation is one of the elements of modern legal systems. The goal sought by the principle is to achieve the greatest possible degree of legal stability and stability for individuals, and despite its importance, the Iraqi legislator did not take it, which exposed the legal centers to a series of sudden and unbalanced fluctuations, and the last approach of the Iraqi legislator was manifested. In the first amendment to the Unified Retirement Law No. (26) Of 2019 in force, as the retirement age was suddenly and suddenly reduced without specifying a transitional period for the application of the provisions of the amendment, and certainly the aforementioned trend undermined the legitimate expectations of those addressed by the legal rule.
