لمعرفة موقف القانون الدولي من التدخل في العراق عام 2003 لابد من بيان المبررات التي ساقتها دول التحالف لتبرير تدخلها العسكري في العراق، ابتداءً طرحت مبرر حيازة العراق لأسلحة الدمار الشامل التي تهدد السلم والأمن الدوليين، مروراً بعلاقة النظام السابق بتنظيم القاعدة الإرهابي المسؤول عن أحداث (11/9/ 2001) وبعدما ثبت كذب هذين المبررين طرحت مبرراً آخر وهو ضرورة تغير النظام الديكتاتوري الحاكم وإحلال نظام ديمقراطي آخر يحترم حقوق الإنسان ويكون نموذجاً تحتذي به دول منطقة الشرق الأوسط، ولكن كل هذه المبررات ثبت زيفها حتى بعد حصول عملية التدخل ولحد يومنا هذا لم يكتشف دليل واحد يؤكد امتلاك العراق أسلحة محظورة، ومبرر علاقة النظام بتنظيم القاعدة الإرهابي لم يتم إثباتها أيضا، أما المبرر الأخير فهو يتعارض مع حق الشعوب في تقرير مصيرها من خلال اختيار نظام الحكم الملائم لها ولذلك فان هذا التدخل يعد انتهاك لحق الشعب العراقي في تقرير مصيره وبنفسه فالشعب هو من يغير النظام الدكتاتوري إلى نظام ديمقراطي.وقد اختلف أيضا التكييف القانوني لتدخل هذه القوات في العراق فابتداءً ادعت بان تدخلها يندرج ضمن نظرية الدفاع عن النفس الوقائي للوقاية من الخطر العراقي المزعوم، بعد ذلك طرحت نظرية التفويض الضمني التي أعطيت لهم بموجب قرارات مجلس الأمن، ولكن هذا التكييفات السابقة لا تنطبق على التدخل في العراق لان التكييف الصحيح للتدخل هو عدوان على دولة وشعب العراق وسندنا في ذلك قرار الجمعية العامة رقم (3314) في عام (1974) المتعلق بالعدوان حيث عرفت المادة (1) منه العدوان بأنه ( استعمال القوة المسلحة من قبل دولة ما ضد سيادة دولة أخرى أو سلامتها الإقليمية أو استقلالها السياسي ...) وهذا التعريف ينطبق كلياً على تدخل دول التحالف في العراق وعليه يصبح تكييف تدخل دول التحالف بالشأن العراقي عدواناً.وقد عمل مجلس الأمن على تحديد المركز القانوني للعراق من الناحية الدولية في ضوء القرارات التي أصدرها، ومن أهمها القرار رقم (1483) الذي اعتبر القوات الأمريكية والبريطانية قوات محتلة من دون ان يدين عملية التدخل أو يطالب القوات المتدخلة بالانسحاب من العراق، بعد ذلك اصدر القرار رقم (1511) الذي بموجبه تم تحول قوات الاحتلال إلى قوات متعددة الجنسيات، وبقى المجلس يتابع حالة العراق حتى إبرام الاتفاقية بين جمهورية العراق والولايات المتحدة الأمريكية بشان انسحاب القوات الأمريكية من العراق وتنظيم أنشطتها خلال وجودها المؤقت في عام (2008) التي حددت العلاقة بين الطرفين.
