Administration is authorized to impose this sort of sanctions upon who violates any legal rule. The exercising of this authority must be controlled by some regulations; objective regulations such as the principle of penal legitimacy, non-retroactivity of sanctions, and the sanctions must not diminish or constrain any freedom or right. Furthermore, there should be proportionality between the sanction and the violation. The second sort of regulations is called procedural regulations which are regarded as grantors of all types of sanctions, for instance, the right of defense, the right of notification of both the penalty and the crime, and the right to appeal the sanction before judiciary.

تعد الجزاءات الإدارية العامة تطبيقا لسياسة الحد من العقاب وترشيدا للنظام العقابي، تلك الجزاءات التي تختص سلطة الإدارة بإيقاعها على كل من ينتهك القوانين والقرارات الإدارية التنظيمية. ولكي تمارس سلطة فرض هذا النوع من الجزاءات لا بد من وجود ضوابط موضوعية وأخرى إجرائية، تتمثَّل الضوابط الموضوعية بلزوم التزام الإدارة بمبدأ الشرعية الجزائية وما يتفرع منها من ضوابط فرعية مثل عدم رجعية القرارات الجزائية على الماضي بأثر رجعي وعدم انطوائها على الحرمان من الحقوق أو تقييدها وعلى مصادرة تلك الحقوق، ناهيك عن لزوم التزامها بالتناسب بين الجزاء والمخالفة. أما الضوابط الإجرائية فهي عبارة عن كل الضمانات التي تخضع لها العقوبات بكل أنواعها، مثل ضمان حق الدفاع وإخطار الجزاء للمعاقب به وتسبيبه وتوفير فرصة الطعن بالجزاء أمام القضاء.
