The position of jurisprudence, has differed in the countries, which is addressed the comparison in terms of the possibility of ruling on the constitutionality or the unconstitutionality of the impugned law as unconstitutional based upon the general unwritten legal principles. The research addressed the basis of the general unwritten legal principles and their mandatory status, and the research also presented the position of these legal principles in the countries such as, France, the United States of America, Egypt and Iraq, and the research shed light the hierarchy of the general unwritten legal principles, as well as the research enhanced some decisions connected to the topic in comparative system. Finally, the research completed with the most important results which were achieved and the recommendations that extracted from the scope of constitutional control of laws on the basis of general unwritten legal principles according to what the researcher deems.

مما لاشك فيه أن الدستور هو القانون الاسمى في الدولة، والذي يعلو على ما عداه من قوانين، إلا إنه (أي الدستور) في نهاية المطاف تشريع من صنع الانسان، بحيث لا يمكن تصور أن يولد كاملاً ليغطي جميع النزاعات، وبالتالي لا يكون امام القاضي إلا أن يخلق حلاً للنزاع المعروض أمامه في حالة وجود نقص في هذا التشريع، ويساهم هذا الحل الذي يخلقه القاضي في إنشاء قاعدة قانونية إذا أخذت به محاكم أخرى، إذ تسمى هذه القاعدة بالمبادئ القانونية العامة.ولقد تباين موقف الفقه في الدول موضوع المقارنة من إذ امكانية الحكم بدستورية أو عدم دستورية القانون المطعون بعدم دستوريته بالاستناد الى المبادئ القانونية العامة غير المكتوبة.تناول البحث أساس المبادئ القانونية العامة غير المكتوبة ومرتبتها الالزامية، وتعرض البحث أيضاً للموقف من هذه المبادئ القانونية في الدول موضوع المقارنة في كل من فرنسا والولايات المتحدة الامريكية ومصر والعراق، وسلط البحث الضوء على تدرج المبادئ القانونية العامة غير المكتوبة، وعزز البحث ببعض القرارات المتعلقة بالموضوع في الانظمة المقارنة.وأخيراً ختم البحث بأهم النتائج التي تم التوصل إليها والتوصيات التي خرج بها والمتعلقة، بمدى رقابة دستورية القوانين على أساس المبادئ القانونية العامة غير المكتوبة وفقاً لما يراه الباحث، ومن الله التوفيق.} }
