إن الانسان مدنيٌ واجتماعيٌ بطبعه ، ولا بد أن يعيش في جماعة ، ويجب أن يحكم الجماعة نظامٌ تسير عليه وتمثلت الجماعةُ في عصرنا الحاضر بشكل كامل بالدولة التي أصبحت ضرورة إنسانية ، واجتماعية واقتصادية ودولية ، وزالت إلى حد بعيد سلطة القبيلة ، وانقسم العالمُ وشعوبه إلى دول مستقلة أو شبه مستقلة وزاد عددها عن (195) دولة ، يتمحور فيها سكانُ العالم وينتمون إليها مقابل الحقوق والواجبات المقررة .وتوضح عادة الدساتير والأنظمة ، والقوانين ، والشرائع ، لتنظيم علاقة الفرد بالدولة ، وبيان حقوقه فيها وواجباته تجاهها وهي بالجملة متمثلة بحق المواطنة .وتختلف دولُ العالم قديماً وحديثاً في حقوق المواطنة ، وتعدد الأنظمة التي تضبط ذلك .وإن الشريعة الإسلامية الغراء بصلاحيتها لكل زمان ومكان وبمعالجتها كافة القضايا في مختلف المجالات وجاءت لتقرر مفهوم المواطنة الذي يعيش تحت سقفه الجميع من كل الملل والنِحل ، وتؤكد أن الإسلام دين للعالمين جميعاً يمكن تحت ظل دولته أن يعيش الناس في مواطنة يعتزون بها ، أساسها العدل والأمن والاحترام المتبادل بين جميع المواطنين} }
