When a judge decides on a particular matter and separates it, he thereby exhausts the power of the authority vested in him on that matter. لا شك ان الحكم القضائي متى ما صدر يظل قائما ومرتبا لأثارة القانونية أي ان القاضي عندما يحسم مسألة معينة ويفصل فيها فأنه بذلك يستنفذ سلطة الحكم المخولة له بشأن تلك المسألة ، فلا يجوز له العدول عما قضي به ، أو أن يعيد النظر فيما سبق الفصل فيه ولو كان حكمه باطلا.والمحكمة اذا ما اصدرت حكمها فإنها تفقد سلطتها ولا يمكن لها ان تعدل عما قضت به او تعدل حكمها سواء أكان تعديل الحكم بالحذف منه ام بالإضافة اليه. إلا أن القاضي قد يصدر الحكم مشوبا بإخطاء معينة او غموض معين ، وقد يغفل أحيانا الفصل في بعض الطلبات المعروضة امامه عند اصدار الحكم ، ويجب لذلك ازالة تلك الحالات الامر الذي يحتم ان يخرج المشرع على قاعدة الاستنفاذ ويجيز للمحكمة التي اصدرت الحكم ان تزيل تلك الاخطاء باعتبارها اقدر المحاكم على ذلك عن طريق مراجعتها من غير الطعن فيها.
