The constitution is imbued with the spirit of separation of public powers in order to limit the authority of the general democratic representative will. Therefore, the provisions of the American Constitution came to confirm that the presidency of the executive authority is through popular election, and that the legislative authority consists of two chambers (the Senate and Representatives) based on the belief that the Senate regulator limits the Extremism of (the People's Representative Council).

قبل قيام الولايات المتحدة الامريكية واعلان استقلالها, كانت ثلاث عشرة ولاية مستعمرة تخضع للتاج البريطاني, وتمارس هذه المستعمرات قدراً من الاستقلال الذاتي, استمر ذلك حتى قيام الثورة على بريطانيا واعلان الاستقلال عام 1776, إذ تحولت تلك المستعمرات الى دول مستقلة, إذ اقتضت ضرورات مواجهة القوات البريطانية تحالف هذه الدول, ثم تكاملت لتشكل الولايات المتحدة الامريكية عام 1789.وكان من ضروريات توحيد الولايات المتحدة الامريكية تقوية السلطة المركزية, لذا تضمن الدستور الاتحادي الامريكي من القواعد ما قصد بها الحد من أخطار (الديمقراطية الشعبية) المتمثلة في مجموع الارادة الشعبية, التي دلت تجارب حرب الاستقلال في الولايات على خطورتها على الاستقلال الاجتماعي, وبالتالي جاءت احكام الدستور مشبعة بروح الفصل بين السلطات العامة وذلك للحد من سلطان الإرادة العامة الديمقراطية النيابية, لذا جاءت احكام الدستور الامريكي لتؤكد على ان تكون رئاسة السلطة التنفيذية بالانتخاب الشعبي, وان السلطة التشريعية تتكون من مجلسين (الشيوخ والنواب) استناداً الى الاعتقاد ان مجلس الشيوخ ناظم يحد من تطرف (المجلس الشعبي النيابي).
