We report on the effectiveness of international law regarding the liability of the violators and the application of indemnity. This subject is attracting an increasing attention as violations to the environment and its living and non-living constituents are increasing.The international responsibility for protecting the environment is no longer an internal affair; it is currently based on the principle of considering the environment as a common humanitarian heritage under the 1982 UN agreement of the Public Seas Law.As the international environmental law is based on the international agreements for protecting the environment and determining the liability of violators, the civil law compliments this protection through its principles which can establish the applicable international rules.The state liability on damages caused to the environment at non-war includes both the state liability for disrespecting the international law and the state liability on permitted activities. The conventional principles for protecting the environment are no longer applicable to the different sorts of illegal international activities harming the environment. Therefore, new rules are being developed to simplify the burden of proof regarding the state’s fault against the environment.

يناقش هذا البحث المسؤولية الدولية عن الأضرار البيئية في ضوء احكام القانون الدولي العام ذات الصلة، و نهدف من خلالها إلى توضيح مدى فعالية وكفاية المسؤولية المتعلقة بالجبر والتعويض عن الأضرار التي تصيب البيئة. ونأمل أن ينال هذا الموضوع اهتمام الباحثين، خاصة بعد الدمار الهائل الذي تعرضت وتتعرض له البيئة بكل عناصرها الحية وغير الحية. فالنظام الخاص بالمسؤولية الدولية لحماية البيئة قائم على فكرة أساسية مفادها أن البيئة ومشكلاتها والمسائل القانونية المتعلقة بهالم تعد أمراً داخلياً محضًا، وإنما هي تجسيد حي لمفهوم التراث المشترك للإنسانية الذي وجد تطبيقه في إطار اتفاقية الأمم المتحدة لقانون البحار لعام 1982.وإذا كان القانون الدولي البيئي يقوم على مجموعة من القواعد القانونية التي تجد مصدرها الأساسي في الاتفاقيات الدولية في مجال المحافظة على البيئة وفي تحديد المسؤولية الدولية عن أضرار التلوث، فإن القانون المدني يتوج هذه الحماية البيئية من خلال مجموعة من المبادئ التي تشكل ركائز أساسية لهذا القانون، والتي يمكن الاستناد اليها في مجال حماية البيئة على المستوى الدولي.وتشمل مسؤولية الدولة عن الأضرار البيئية وفي وقت السلم: مبدأ مسؤولية الدولة عن خرق القانون الدولي، ومبدأ مسؤولية الدولة عن الأضرار الناشئة عن الأنشطة المسموح بها بموجب القانون الدولي. ومهما كانت النظريات المطبقة على الأفعال الدولية غير المشروعة بشأن البيئة فإن قواعد المسؤولية التقليدية لم تعد تتماشى معها لأنها قائمة على عنصر الخطأ، أو العمل غير المشروع الذي يؤدي إلى سهولة إفلات الدولة من المسؤولية.هذا الواقع حدا في البحث عن نظريات أخرى تخفف من أحكام المسؤولية الدولية التقليدية.
