The main characteristic of these bodies is that they work independently from the executive authority, this characteristic did not exist elsewhere as the counterparts of these bodies was subject to the executive authority such as in United States. The Iraqi constitution of 2005 has applied the French approach with some slight differences do not touch the gist of the French model which has been adopted in Iraq. Despite that, there has been an amount of ambiguity in the legal treatment of these bodies in the constitutional wording which has arisen some questions about the nature of these bodies can be comparable to those which were discussed under the French jurisdiction such as whether these bodies are public authorities or they are mere advisory bodies or such as whether these bodies could be deemed as a four authority in addition to the classic three authorities. The current Iraqi constitution is based on the rule of law as it comprehensively states liberties and rights with guarantees to apply them by the public authorities which include judicial censorship on executive and legislative authorities, moreover, there is another guarantee which has been stated in the Iraqi constitution which is the independent bodies which can work to censor actions of government. In this article, the author tried to examine the nature of these bodies that the Iraqi constitution of 2005 stated, the article has been divided into two sections, in the first one the author will study the functions of the state whereas the second will demonstrate the independent bodies in Iraq.

الخلاصةمن الأمور المستجدة في القانون العام هو موضوع الهيئات المستقلة والذي ظهر أولا في فرنسا عام 1941 عن طريق التشريع العادي ثم عاد المشرع عام 1975 لينشئ هيئات مستقلة أخرى والتي سميت في فرنسا بالسلطات المستقلة ثم اخذ المشرع بعد هذا التاريخ بإنشاء العديد من هذه السلطات. وميزة هذه الهيئات أنها مستقلة بشكل شبه تام عن السلطة التنفيذية وهو الأمر الذي لم يطبق في دول أخرى, والتي كانت الهيئات التي تنشأ فيها تخضع للسلطة التنفيذية بشكل أو بآخر كما هو الحال في الولايات المتحدة الأمريكية. وجاء الدستور العراقي لسنة 2005 ليطبق النموذج الفرنسي في الهيئات المستقلة مع بعض الاختلافات التي لا تؤثر على جوهر النموذج الفرنسي المطبق من قبل الدستور العراقي. لقد نص الدستور العراقي النافذ لسنة 2005 على الهيئات المستقلة في الباب الثالث منه لكن نصوصه حول هذه الهيئات كانت صياغتها غامضة في الظاهر حول طبيعة هذه الهيئات. وتثور حول النصوص الدستورية لسنة 2005 نفس التساؤلات التي أثيرت في فرنسا خصوصاً في بداية التجربة الفرنسية حول طبيعة هذا النموذج الجديد من الهيئات, وهي هل أن هذه الهيئات هي سلطة عامة أم استشارية؟ وإذا كانت سلطة عامة فهل هي سلطة رابعة إلى جانب السلطات الثلاث أم لا؟ وإذا لم تكن سلطة رابعة فهل هي جزء من السلطة التشريعية أم التنفيذية أم القضائية؟ إن عمل الهيئات المستقلة هو لتعزيز فلسفة دولة القانون التي بني عليها دستور 2005, وفيها على الجميع حكام ومحكومين احترام القانون وعدم استخدام السلطة العامة من قبل الحكام لإغراض خاصة بل لتسيير المرافق العامة التي تضمن إشباع الحاجات العامة للأفراد والتي هي من خصائص دولة القانون. ولضمان قيام هذه الهيئات بوظيفتها وهي وظيفة تنفيذية ,كما أثبتنا ذلك في البحث, فقد قام المشرع الدستوري بتبني النموذج الفرنسي الذي تستقل فيه الهيئات المستقلة عن السلطة التنفيذية استقلال شبه تام من حيث الأشخاص والنشاط مع احتفاظ هذه الهيئات بصفتها التنفيذية أو الإدارية. كما أن هذه الهيئات تخضع للسلطة التشريعية رغم أنها ليست منها.
