The role of the penal protection of the elections in Strengthen parliamentary democratic system

Abstract

Abstract The legislator provides penal protection of the electoral process by criminalizing acts that affect the electoral process, however, Carefully considering of these penal provisions is clear that it do not achieve adequate protection of the electoral process and it do not function the promotion of democracy, where easily evade it because of the nature of its provisions, especially those relating to the statute of limitations or because of parliamentary immunity to members of the House of Representatives, which requires a review of these provisions so as to ensure accountability of committed fairly and strengthens the democratic process in the country, This research dealt with the role of penal protection for the elections in strengthening of the parliamentary democratic system, through a statement justifications for criminalization of crimes and the electoral consequences of electoral crimes, as well as the substantive provisions of the electoral crimes, and the statement of electoral offenses under the election law No. 25 of 2012, and finally the effectiveness of the penal protection to curb electoral crimes, the researchers have reached to a number of findings and recommendations.Key words : Electoral crimes, Penal protection, The democratic system
