The concept of statute of limitations in the Juvenile Care Act

Abstract

Prescription is a legal system consequent in an expiration of the right if the proprietor of the right does not use it during the specified period. If a final issued judgment was not implemented or the necessary methods to implement it were not taken an action during a certain period , this arrangement wil fall by prescription. The Iraqi legislator did not take prescription as a rule in criminal law except in specific exceptions. But , the Iraqi juveniles care law No. 76 in 1983, takes the prescription in a quality in the felonies and misdemeanors, aiming for prevention, rehabilitation and treatment in accordance with the special criminal policy of the juvenile delinquency. Beside the prescription cases, there is a measure of prescription provided for in Article (70) of the Juvenile Welfare Act and the Iraqi move means a period of time specified by law during which the convict escapes from the implementation of the measure , and no procedure has been taken during this period, a procedure to be implemented and built upon the fall of the measure is to built against it the legislature did not regulate the provisions of the interruption and its stoppage it and the consequent effects on them and thus the paps addresses these issues of importance in the proper application of the legal text.
