The obligation to grant the exclusive rights in petroleum investment contracts

Abstract

The obligation to grant the exclusive rights is one of the main obligations in various contracts in particular the petroleum investment contracts in which it gives to the granted company exclusive rights in the realm of the contract as concerned the research, excavation , and production. The legal base for this right arising from the obligation of non interfering obligation imposed upon the state granting these exclusive rights in spite of that right there are two limitations imposed on the company namely the best use and alienation principles. In addition to the exclusive right there are many related rights which are not exclusive in their nature yet they are vital to give the exclusive rights their legal efficacy. The research has been divided into three chapter :- the first has been specified to define the exclusive rights either to illustrate their contents and limitations, the second to determine their legal domain which is the petroleum investment contracts , and the third has been specified for the related rights connected with the obligation to grant the exclusive rights . the research will be ended by some final conclusions and recommendations
