Inheritance according to the tribal Tradition in Pre-Islamic Time of the Prophet

Abstract

Inheritance has occupied a prominent aspect among the pre-Islamic Arabs. The distribution of inheritance differed between urban and rural communities . In urban communities m inheritance was distributed according to the laws that represent the authorities' point of view exemplified in the codes that were established in Mesopotamia like of : ( Ur-Nammu's code, Laws of Eshnunna, and code of Hammurabi ).The rural community from the other hand distributed the inheritance according to the tribal norms and traditions . This method of distributed in the tribal community even when it adversely effected the life of certain segments in the community The status however changed with the advent of Islam that organized the system of inheritance according to fixed and accepted basis ensuring the rights of everyone of the inheritors without discrimination.
