Abstract

The administration of President George W. Bush after the entry of American troops into Iraq, adopted a policy of depending on the security contractors in order to minimize the casualties of the military forces, so this policy has its own effects on the political and public sides ...and to circumvent on the legal restrictions governing the work of the professional Army, on the other side. The U.S. armed forces made contracts with a number of these companies, for example; Danny Group International company and Triple Canopy and Black water, where the goal of the work of these companies in Iraq is to provide security for the diplomatic missions and to ensure the protection of airports and security coordination and also to protect the Oil pipelinesThe role of private security companies is growing up in a number of countries that have military operations.... Thus, this matter requires the use of the mandate of these private security companies, so that leads to friction of these companies with the people. This connection leads to the occurrence of damage, for example traffic accidents may result a kind of violations, this violation is conceived as a breach of international humanitarian law. So the phenomenon of these security groups prompted researchers to study the companies to determine their status, according to the international humanitarian law and the criminal law ..... My research is an attempt to study the legal framework of criminal responsibility for these companies and the legal rules that govern their activities, especially after serious violations of international humanitarian law, which have been committed by members of these companies. .... Sparking a sensation at all levels about the legality of the existence of these companies and the rules of international law…So I tried to deal with this subject through the following topics: Preliminary Section, titled, .... the origins and evolution of the private security companies and what are the most important factors that contributed to their appearance.First Section:1-Deals with ....The study of these companies in three paragraphs; definition demands of these companies and the elements that make up the most important statement. 2- The manifestation of the dominant people leading these private security companies. 3- The national and international efforts that regulate the work of these companies.The second Section .... deals with the legal adaptation of the private security companies, through three paragraphs; ... 1- A study of Iraqi criminal law and its application to certain crimes committed by the private security companies. 2- The legal status of the security companies in Iraq, for example (Black water). 3-The criminal liability of the private security companies.
