تتجه الدول في الوقت الراهن الى تكريس مبدأ مكافحة الفساد في دساتيرها باعتباره أحد الأسس الرئيسية لعملية الاصلاح والتنمية والحكم الرشيد، وليصبح جزء لا يتجزأ من البنيان الدستوري للدولة الذي تتمتع قواعده بالسمو الشكلي والموضوعي وتتوسد قواعده قمة النظام القانوني، كما يحتم وجوده في هذا البنيان التزام جميع السلطات العامة بأسسه وأهدافه وآليات تحققه، سيما وأن الدساتير هي التعبير عن إرادة واحتياجات الشعوب، فالنص على مكافحة الفساد في حد ذاته يعبر عن مدى خطورة الاثار السلبية التي يمكن أن تتأثر بها الدول من جراء الفساد بأشكاله. إلا أن مجرد النص على مبدأ مكافحة الفساد في الدساتير في حد ذاته لا يعد كافيا في مكافحة الفساد إذ يتعين على المشرع الدستوري أن يضمن تطبيقه من خلال تبنيه لعدد من الآليات: دستورية وتشريعية وقضائية ومؤسسية لمكافحة الفساد تضمن توفير الحماية الدستورية للدولة من الفساد والوقاية من أضراره.واتجه دستور جمهورية العراق لعام 2005 إلى تكريس المبادئ الدستورية التي تعزز مكافحة الفساد والى تبني آليات دستورية وتشريعية ومؤسسية وقضائية، راميا من وراء ذلك الى تبني الحكومة والبرلمان والمؤسسات الرقابية استراتيجية محددة لمكافحة الفساد في اطار هذه النصوص، الا أن تبني السلطات العامة والمؤسسات الرقابية لهذه الاستراتيجية والتزامها بالنصوص الدستورية قد شابه بعض الخلل واعتراه جوانب من القصور مما أدى الى تفشي هذه الظاهرة بدلا من انحسارها.

Abstract:The administrative and Financial Corruption in the state of Iraq appears in two form : Identified and Structural Corruption . By Identified Corruption We wean the encroachment upon the public assets by corrupted individuals , or gpoups of officials , making use of their governmental positions . While by Structural Corruption we mean tbe inflation in the state apparatus , caused by the so – called " Masked Unemployment " . The Masked Unemployment in Iraqi state reached unbelivable limits in recent years . It is estimated , that about 80% percent of the total number of the state employees . It constitutes a heavy burden upon the state budget About 60 % percent of state expenditure . In addition to its financial consequences , Macked Unemployment leads tbe flaccidity of the state apparatus , and decline in its efficiency . the inflation of state apparatus is related to the increase in petroleum revenues Instead of the efficient use of these revnenues in the rebuilding of the destroyed infrastructure of Iraqi economy , it became a source for the finan cial corruption in its two above mentioned forms . It becoame a vital ncessity to subject ehe inflation of Iraqi state to a strict regime with the aim of eliminating masked unemploywent in the state apparatus in Iraq . Depending on strategic , social and economic plans which can mobolise all the available resources in the Iraqi state ( Financial , material and human ) , the dilemma of Masked Unemployment in Iraq will find rational solutions on the long range .

المســتخلص :نقصد بالفساد المالي لأغراض هذا البحث : التطاول على المال العام ، استئثارا و / او تبديدا . وينقسم الفساد المالي الى شكلين :الفساد المشخصن Identified Corruption ، والفساد البنيوي Structural Corruption ونقصد بالفساد المشخصن : الاستئثار بالمال العام والانتفاع غير المشروع منه او على حسابه من قبل موظف مفسد فرد ، او شبكة من الموظفين المفسدين يتضامنون على تمرير الفساد والتستر عليه ، واقتسام مغانمة . يركز البحث على الفساد البنيوي الذي يرقد في بناء الدولة العراقية ، ويتمثل في البطالة المقنعة المستشرية فيه . ويذهب البحث الى تقديرها بزهاء 80 % من عدد العاملين في جهاز الدولة . وهو مايكلف الموازنة العامة السنوية زهاء 60 % من اعتماداتها .ويقود استحداث المزيد من الوظائف العامة سنويا الى تضخم جهاز الدولة وترهله وتدني فاعليته . وهو مايدلل على ان اصحاب القرار السياسي ليس لهم رؤية تنموية متكاملة للبلد ، مؤهلة لخلق فرص عمل للعاطلين . فيلجأون الى الطريق الأسهل في تشغيل القوى العاملة بتعيينهم في اجهزة الدولة . ويعد ذلك خطأ كبير بمعايير الجدوى الاقتصادية للانفاق الحكومي.يقترن التضخم الكبير والمتعلق في جهاز الدولة العراقية بزيادة عوائد النفط ، وبدلا من توظف تلك العوائد لتطوير العراق واعادة بناء بنيته التحتية المخربة ، اصبحت نهبا للفساد المالي والاداري بشكليه : المشخصن والبنيوي . لقد بات من الملح اعادة بناء الدولة العراقية واخضاعها لنظام حمية صارم ، يزيل عنها شحوم الترهل وتدني الفاعلية . وفي مقدمة المهمة ايجاد معالجات تنموية لفرص العمل خارج جهاز الدولة .

موضوع الفساد الاداري و المالي من المواضيع التي بدات تسمع في مجتمعنا بكثرة و بالخصوص بعد عام 2003 و مع تزايد الانتعاش الاقتصادي في العراق و تحوله نحو الديمقراطية . ولكن نسمع بان الفساد الاداري و المالي يعتبر جريمة و معاقب عليها قانونا .فهل هناك قانون محدد يجرم الفساد الاداري و المالي ؟هل الفساد الاداري و المالي جريمة محددة الاركان ؟وهناك كثير من التساؤلات التي تطرح في هذا البحث نسلط الضوء عليها محاولين ايجاد الاجابة القانونية لها في ضوء قانون العقوبات العراقي النافذ و المعدل . حيث سنبحث في تعريف الفساد و اصنافه و الصور التي ورد بها في قانون العقوبات كجريمة باعتباره جنحة او جناية و العقوبة القررة لها قانونا. و ما هي المقترحات التي يمكن طرحها كوسائل للحد من تنامي هذه الظاهرة و وضع حلول قانونية ناجعة لمعالجتها .

تعد ظاهرة الفساد الإداري من الظواهر المتفشية في الوقت الحاضر ولها صور كثيرة وكلها تعد خروجا على القانون والنظام كاستغلال المال العام من اجل تحقيق مصالح سياسية أو اقتصادية أو اجتماعية للفرد أو لجماعة معينة.وهو بذلك يجافي الأخلاق والآداب العام لأي بلد وإساءة لاستعمال السلطة أو الموقع الوظيفي بحيث يعطي للبعض أفضلية على الآخرين. وقد بين البحث أن أسباب الفساد متنوعة منها اقتصادية قد ترجع إلى البطالة وضآلة المرتبات وشعور المواطن بالحاجة المادية التي تولد لديه ردة فعل مما يؤدي إلى استشراء الفساد ، وقد يرجع الانحراف الإداري إلى سوء صياغة القوانين واللوائح المنظمة للعمل. وقد اقترحنا من خلال البحث جملة من السبل العلاجية والوقائية التي نعتقد أن المشرع العراقي من الممكن أن يفيد منها في مكافحة هذه الآفة الخطيرة التي تفشت بصورة واسعة في المرحلة التي أعقبت انهيار النظام البائد سنة 2003.
