أن حاجة المستهلكین للسلع والخدمات تدفعهم إلى التعاقدبشيء من السرعة و العجلة مع المحترفین ،بغیةالحصول على ما یرومون إلیه لحاجتهم الماسة . ونظراً لتنامي مقومات ضعف المستهلك بسبب التطورالصناعي والتقدم التكنولوجي اللذین أدیا إلى تغییر ملحوظ في أسالیب إنتاج السلع وتقدیم الخدمات وطرقتوزیعها وتسویقها . إذ أن المحترف أصبح یمارس نشاطاته من خلال شركات ضخمة تمتلك المعلومات إضافة إلى قدرتها الاقتصادیة ، مما یسهل علیه استخدام شتى أنواع وسائل الترویج والدعایة الحدیثة مثل الإعلانات التي قد تتضمن معلومات مضللة أو كاذبة، ناهیك عن طریقة تحریرها بوساطة عقود نموذجیة تتضمن شروطاً اغلبها في صالح المهني فالعلاقة التعاقدیة بین طالبي السلع والخدمات ومقدمیها علاقة غیر متكافئة بسبب التفوق الاقتصادي والقانوني والمعرفي والتقني للأخیر.وتهدر حقوق المستهلك لذا توصف بالتعسفیة .إزاءهذه المعطیات والمستجدات وقصور القواعد العامة المنظمة لإحكام العقد في التشریعات المدنیة أصبح إیجاد قواعد قانونیة خاصة بحمایة المستهلكین في غایة الأهمیة .وهكذا فأن هذا البحث یهدف إلى محاولة حمایة المستهلكین عبر الانترنت بمنحهم بعد إبرام العقد مكنةالعدول عن التعاقد المتسرع خلال مهل معینة حددها القانون بحسب السلع والخدمات حیث غالباً ما نجد أنْ المستهلك یقدم على التعاقد دون دراسة متأنیة وتروٍ كافٍ فیكشف بعد إبرام العقد فوات الأوان بأنه لم یكن یرغب في إبرام هذا العقد حقیقة .علیه تتناول هذه الدراسة العدول عن التعاقد عبر الانترنت ، عن العقد الذي سبق أن ابرمه المستهلك كإحدى الوسائل القانونیة الحدیثة لتوفیر الحمایة للمستهلكین في مرحلة تنفیذ العقد بغیة مواجهة سرعة انعقاد عقود الاستهلاك التي تبرم عن بعد بصفة خاصة ، وعلیه فقد تناولنا في المبحث الأول ماهیة العدول عن التعاقد.ومن ثم بیان التنظیم القانوني في المبحث الثاني .أما في المبحث الثالث فنعرض إلى آثار العدول عن التعاقد، مسلطین البحث عن قواعد حمائیة في التشریعات الخاصة بحمایة المستهلكین والتشریعات المنظمةللمعاملات والتجارة الالكترونیة التي تعرضت لموضوع حمایة المستهلك في معاملاته الالكترونیة وقد خرجنا في نهایة هذه الدراسة إلى أن على الرغم من وجود حلول قانونیة جزئیة بصدد المشاكل التي یواجها المستهلك في نطاق العقود التي یبرمها مع المحترف ضمن القواعد العامة ، ولكن مع ذلك تعتري هذه القواعد جوانب القصور بسبب عدم مسایرتها للتطورات والمستجدات التي حصلت في أطار التعاملات الحدیثة خصوصاً . یستوجب إعادة النظر في القواعد العامة وتحدیثها واستحداث قواعد قانونیة خاصة تتماشى مع هذه التطورات .وكان من بین توصیات هذه الدراسة إعادة النظر في قانون حمایة المستهلك فضلاً عن ضرورةالنص بصورة خاصة على حق العدول بهدف حمایة المستهلكین بعد إبرام العقد .
